Damos-lhe as boas-vindas a SmartStaging! Os termos “nós” e “nosso” referem-se a SmartStaging. SmartStaging opera esta loja e website, incluindo todas as informações, conteúdo, funcionalidades, ferramentas, produtos e serviços relacionados, a fim de lhe proporcionar, a si, o cliente, uma experiência de compra personalizada (os “Serviços”). SmartStaging conta com tecnologia Shopify, o que nos permite prestar-lhe os Serviços.

SECÇÃO 1 — ACESSO E CONTA
Ao concordar com os presentes Termos de Serviço, declara que atingiu, pelo menos, a maioridade no estado ou província onde reside e que nos deu o seu consentimento para permitir que qualquer um dos seus dependentes menores utilize os Serviços em dispositivos que possua, compre ou gira.
Para utilizar os Serviços, incluindo aceder ou navegar nas nossas lojas online ou comprar qualquer um dos produtos ou serviços que oferecemos, poderá ser-lhe pedido que forneça determinadas informações, como o seu endereço de e-mail e informações de faturação, pagamento e envio. Declara e garante que todas as informações que fornecer nas nossas lojas estão corretas, atualizadas e completas e que possui todos os direitos necessários para fornecer estas informações.
A responsabilidade por manter a segurança das credenciais da sua conta e por toda a atividade da sua conta é exclusivamente sua. Não pode transferir, vender, ceder ou licenciar a sua conta a qualquer outra pessoa.

SECÇÃO 2 — OS NOSSOS PRODUTOS
Envidámos todos os esforços para fornecer uma representação precisa dos nossos produtos e serviços nas nossas lojas online. No entanto, tenha em atenção que as cores ou o aspeto do produto podem ser diferentes da forma como aparecem no seu ecrã devido ao tipo de dispositivo utilizado para aceder à loja e às definições e configurações do seu dispositivo.
Não garantimos que o aspeto ou a qualidade de quaisquer produtos ou serviços comprados por si correspondam às suas expectativas ou sejam iguais aos apresentados ou ilustrados nas nossas lojas online.

Reservamo-nos o direito de descontinuar qualquer produto a qualquer momento e podemos limitar as quantidades de quaisquer produtos que oferecemos a qualquer pessoa, região geográfica ou jurisdição, numa base casuística.

SECÇÃO 3 — ENCOMENDAS
Quando efetua uma encomenda, está a efetuar uma oferta para comprar. SmartStaging reserva-se o direito de aceitar ou recusar a sua encomenda por qualquer motivo, a respetivo critério exclusivo. A sua encomenda não será considerada aceite até que SmartStaging confirme a aceitação. Temos de receber e processar o pagamento antes de a sua encomenda ser aceite. Antes de submeter a sua encomenda, reveja-a atentamente, uma vez que SmartStaging pode não ser capaz de satisfazer pedidos de cancelamento após a encomenda ser aceite. Caso não aceitemos, efetuemos alterações ou cancelemos uma encomenda, tentaremos enviar-lhe uma notificação através do e-mail, endereço de faturação e/ou número de telefone fornecidos no momento em que a encomenda foi efetuada.
As suas compras estão sujeitas a devolução ou troca apenas de acordo com a nossa Política de Reembolso [LINK].
O utilizador declara e garante que as compras que efetuar destinam-se a uso pessoal ou doméstico e não a revenda comercial ou exportação.

SECÇÃO 4 — PREÇOS E FATURAÇÃO
Os preços, descontos e promoções estão sujeitos a alterações sem aviso prévio. O preço cobrado por um produto ou serviço será o preço em vigor no momento em que a encomenda é efetuada e estará indicado no e-mail de confirmação da sua encomenda. Salvo indicação expressa em contrário, os preços publicados não incluem impostos, envio, manuseio ou taxas alfandegárias ou de importação.
Os preços publicados nas nossas lojas online podem ser diferentes dos preços oferecidos nas lojas físicas ou em lojas online ou de outro tipo operadas por terceiros. Periodicamente, podemos oferecer promoções sobre os Serviços, as quais podem afetar os preços e são regidas por termos e condições separados dos presentes Termos. Em caso de conflito entre os termos de uma promoção e os presentes Termos, prevalecerão os termos da promoção.
Concorda em fornecer informações atualizadas, completas e precisas sobre a compra, o pagamento e a conta em todas as compras efetuadas nas nossas lojas. Concorda em atualizar imediatamente a sua conta e outras informações, incluindo endereço de e-mail, números de cartão de crédito e datas de validade, para que possamos concluir as transações e contactar o utilizador, conforme necessário.
Declara e garante que (i) as informações do cartão de crédito fornecidas são verdadeiras, corretas e completas, (ii) possui a devida autorização para utilizar esse cartão de crédito para efetuar a compra, (iii) as cobranças incorridas por si serão honradas pela empresa do seu cartão de crédito e (iv) pagará as cobranças incorridas por si aos preços publicados, incluindo os valores cobrados por envio e manuseio e todos os impostos aplicáveis, se existirem.

SECÇÃO 5 — ENVIO E ENTREGA
Não somos responsáveis por atrasos no envio e na entrega. Todos os tempos de entrega são apenas estimativas, pelo que não constituem garantias. Não nos responsabilizamos por atrasos causados por transportadoras, processamento alfandegário ou eventos fora do nosso controlo. Quando transferimos os produtos para a transportadora, o título e o risco de perda são transferidos para si.

SECÇÃO 6 — PROPRIEDADE INTELECTUAL
Os nossos Serviços, incluindo, entre outros, todas as marcas comerciais, marcas, texto, expositores, imagens, gráficos, avaliações de produtos, vídeo e áudio, assim como o design, seleção e disposição dos mesmos, são propriedade de SmartStaging, dos respetivos afiliados ou licenciadores e estão protegidos pelas leis de patentes, direitos de autor e outras leis de propriedade intelectual dos EUA e estrangeiras.
Os presentes Termos permitem-lhe utilizar os Serviços apenas para uso pessoal e não comercial. Não pode reproduzir, distribuir, modificar, criar trabalhos derivados, expor publicamente, executar publicamente, voltar a publicar, transferir, armazenar ou transmitir qualquer material sobre os Serviços sem o nosso consentimento prévio por escrito. Exceto conforme expressamente previsto no presente documento, nada nestes Termos concede ou deve ser interpretado como concessão de uma licença ou outros direitos para si ao abrigo de qualquer patente, marca comercial, direitos de autor ou outra propriedade intelectual de SmartStaging, da Shopify ou de qualquer terceiro. A utilização não autorizada dos Serviços pode constituir uma violação das leis de propriedade intelectual federais e estatais. SmartStaging reserva-se todos os direitos não expressamente concedidos no presente documento.
Os nomes, logótipos, nomes de produtos e serviços, designs e slogans de SmartStaging são marcas comerciais de SmartStaging ou dos respetivos afiliados ou licenciadores. Não pode utilizar estas marcas comerciais sem a permissão prévia por escrito de SmartStaging. O nome, logótipo, nomes de produtos e serviços, designs e slogans da Shopify são marcas comerciais da Shopify. Todos os outros nomes, logótipos, nomes de produtos e serviços, designs e slogans sobres os Serviços são marcas comerciais dos respetivos proprietários.

SECÇÃO 7 — FERRAMENTAS OPCIONAIS
Poderá ser-lhe fornecido acesso a ferramentas de cliente oferecidas por terceiros como parte dos Serviços, sobre as quais não efetuamos qualquer monitorização, controlo ou contribuição.
Reconhece e concorda que fornecemos acesso a estas ferramentas “conforme estão” e “conforme disponíveis”, sem quaisquer garantias, representações ou condições de qualquer tipo e sem qualquer endosso. Não temos qualquer responsabilidade decorrente ou relacionada com a sua utilização das ferramentas opcionais de terceiros.
Qualquer utilização sua das ferramentas opcionais oferecidas através do website é realizada inteiramente por sua conta e risco, pelo que deve garantir que está tem conhecimento e aprova os termos em que as ferramentas são fornecidas pelo(s) fornecedor(es) terceiro(s) relevante(s).
Futuramente, também podemos oferecer novas funcionalidades através dos Serviços (incluindo o lançamento de novas ferramentas e recursos). Estas novas funcionalidades devem igualmente ser consideradas como parte dos Serviços e estão sujeitas aos presentes Termos de Serviço.

Não somos responsáveis por quaisquer danos ou prejuízos relacionados com o seu acesso a quaisquer websites de terceiros, ou pela sua compra ou utilização de quaisquer produtos, serviços, recursos ou conteúdo em quaisquer websites de terceiros. Deve rever atentamente as políticas e práticas de terceiros e garantir que as compreende antes de efetuar qualquer transação. As reclamações, reivindicações, dúvidas ou perguntas relacionadas com produtos e serviços de terceiros devem ser direcionadas ao terceiro.

SECÇÃO 9 — RELAÇÃO COM A SHOPIFY

SmartStaging conta com tecnologia Shopify, o que nos permite prestar-lhe os Serviços. No entanto, quaisquer vendas e compras que efetuar na nossa Loja são efetuadas diretamente a SmartStaging. Ao utilizar os Serviços, reconhece e concorda que a Shopify não é responsável por qualquer aspeto de qualquer venda entre si e SmartStaging, incluindo quaisquer lesões, danos ou perdas resultantes dos produtos e serviços comprados. Pelo presente, isenta expressamente a Shopify e os respetivos afiliados de quaisquer reivindicações, danos e responsabilidades resultantes ou relacionados com as compras e transações que efetuar com SmartStaging.

SECÇÃO 10 — POLÍTICA DE PRIVACIDADE
Todas as informações pessoais que recolhemos através dos Serviços estão sujeitas à nossa Política de Privacidade, que pode consultar aqui [LIGAÇÃO], e determinadas informações pessoais podem estar sujeitas à Política de Privacidade da Shopify, que pode consultar aqui. Ao utilizar os Serviços, confirma que leu estas políticas de privacidade.
Como os Serviços são alojados pela Shopify, a Shopify recolhe e trata informações pessoais relativas ao seu acesso e utilização dos Serviços a fim de prestar e otimizar os Serviços. As informações que submeter aos Serviços serão transmitidas e partilhadas com a Shopify, assim como com terceiros que podem estar localizados em países diferentes do seu país de residência, para lhe prestar serviços. SECÇÃO 11 — FEEDBACK
Se submeter, carregar, publicar, enviar por e-mail ou, de outra forma, transmitir quaisquer ideias, sugestões, feedback, avaliações, propostas, planos ou outro conteúdo (coletivamente, “Feedback”), concede-nos uma licença perpétua, mundial, sublicenciável e isenta de royalties para utilizar, reproduzir, modificar, publicar, distribuir e apresentar esse Feedback em qualquer meio para qualquer finalidade, incluindo para uso comercial. Podemos, por exemplo, utilizar os nossos direitos ao abrigo da presente licença para operar, fornecer, avaliar, otimizar, melhorar e promover os Serviços e para cumprir as nossas obrigações e exercer os nossos direitos ao abrigo dos Termos de Serviço.
Também declara e garante ainda que: (i) possui ou dispõe de todos os direitos necessários sobre qualquer Feedback; (ii) divulgou qualquer compensação ou incentivos recebidos no âmbito da submissão do Feedback; e (iii) o seu Feedback estará em conformidade com os presentes Termos. Não temos nem teremos qualquer obrigação de (1) manter o seu Feedback confidencial; (2) pagar-lhe uma compensação pelo Feedback; ou (3) responder ao seu Feedback.
Podemos, mas não temos qualquer obrigação de monitorizar, editar ou remover Feedback que determinemos, a nosso exclusivo critério, ser de caráter ilegal, ofensivo, ameaçador, calunioso, difamatório, pornográfico, obsceno ou censurável de que, de outra forma, viole a propriedade intelectual de terceiros ou os presentes Termos de Serviço.
Concorda que o seu Feedback não violará qualquer direito de quaisquer terceiros, incluindo direitos de autor, marcas comerciais, privacidade, personalidade ou qualquer outro direito pessoal ou de propriedade. Concorda ainda que o seu Feedback não irá conter Feedback difamatório ou ilegal, abusivo ou, de outra forma, obsceno, nem irá conter qualquer vírus informático ou outro malware que possa, de alguma forma, afetar a operação dos Serviços ou de qualquer website relacionado. Não pode usar um endereço de e-mail falso, fingir ser outra pessoa ou, de outra forma, enganar-nos ou a terceiros sobre a origem de qualquer Feedback. A responsabilidade por qualquer Feedback que partilhe, assim como a exatidão do mesmo, é exclusivamente sua. Não nos responsabilizamos nem assumimos qualquer responsabilidade por Feedback publicado por si ou terceiros.

SECÇÃO 12 — ERROS, IMPRECISÕES E OMISSÕES
Ocasionalmente, poderão existir informações nos ou sobre os Serviços que contenham erros tipográficos, imprecisões ou omissões relativamente a descrições de produtos, preços, promoções, ofertas, taxas de envio de produtos, prazos de envio e disponibilidade. Reservamo-nos o direito de corrigir quaisquer erros, imprecisões ou omissões, de alterar ou atualizar informações ou de cancelar encomendas se alguma informação for imprecisa, em qualquer momento e sem aviso prévio (incluindo após a sua submissão de uma encomenda).

SECÇÃO 13 — UTILIZAÇÕES PROIBIDAS
Pode aceder e utilizar os Serviços apenas para finalidades legais. O utilizador não pode aceder ou utilizar os Serviços, direta ou indiretamente: (a) para qualquer fim ilícito ou malicioso; (b) violar quaisquer regulamentos internacionais, federais, distritais ou estatais, regras, leis ou decretos locais; (c) infringir ou violar os nossos direitos de propriedade intelectual ou os direitos de propriedade intelectual de terceiros; (d) assediar, maltratar, insultar, prejudicar, caluniar, difamar, denegrir, intimidar ou causar dano a qualquer um dos nossos funcionários ou a qualquer outra pessoa; (e) transmitir informações falsas ou enganosas; (f) enviar, receber intencionalmente, carregar, transferir, utilizar ou reutilizar qualquer material que não esteja em conformidade com os presentes Termos; (g) transmitir ou facilitar o envio de qualquer material publicitário ou promocional, incluindo qualquer “correio não solicitado”, “mensagem em cadeia”, “spam” ou qualquer outra solicitação semelhante; (h) fazer-se passar ou tentar fazer-se passar por qualquer outra pessoa ou entidade; ou (i) adotar qualquer outro comportamento que condicione ou iniba a utilização ou o usufruto dos Serviços por qualquer pessoa ou que, conforme determinado por nós, possa causar danos a SmartStaging, à Shopify ou aos utilizadores dos Serviços, ou expô-los a responsabilidades.
Adicionalmente, concorda em não: (a) carregar ou transmitir vírus ou qualquer outro tipo de código malicioso que será ou poderá ser utilizado de qualquer forma que possa afetar a funcionalidade ou a operação dos Serviços; (b) reproduzir, duplicar, copiar, vender, revender ou explorar qualquer parte dos Serviços; (c) recolher ou rastrear informações pessoais de terceiros; (d) realizar ações de spam, phishing, pharm, pretexto, spider, crawl ou extração; ou (e) interferir ou contornar as funcionalidades de segurança dos Serviços ou de qualquer website relacionado, outros websites ou da Internet. Reservamo-nos o direito de suspender, desativar ou encerrar a sua conta a qualquer momento, sem aviso prévio, se determinarmos que violou alguma parte dos presentes Termos.

SECÇÃO 14 — RESCISÃO
Podemos rescindir o presente contrato ou o seu acesso aos Serviços (ou a qualquer parte dos mesmos) a nosso exclusivo critério, a qualquer momento, sem aviso prévio, e permanecerá responsável por todos os montantes devidos até à data da rescisão, inclusive.
As secções que se seguem continuarão a ser aplicáveis após qualquer rescisão: Propriedade Intelectual, Feedback, Rescisão, Exclusão de Responsabilidade de Garantias, Limitação de Responsabilidade, Indemnização, Divisibilidade, Renúncia de Responsabilidade; Integralidade do Contrato, Cessão, Lei Aplicável, Política de Privacidade e quaisquer outras disposições que, em virtude da sua natureza, prevaleçam à rescisão.

SECÇÃO 15 — EXCLUSÃO DE RESPONSABILIDADE DE GARANTIAS
As informações apresentadas nos Serviços ou através dos mesmos são disponibilizadas apenas para efeitos de informação geral. Não garantimos a exatidão, integralidade ou utilidade destas informações. A confiança depositada por si nestas informações é estritamente por sua conta e risco. Excluímos toda a responsabilidade decorrente de qualquer confiança depositada nestes materiais por si ou por qualquer outro visitante dos Serviços, ou por qualquer pessoa que possa ser informada de qualquer parte do seu conteúdo.
EXCETO CONFORME EXPRESSAMENTE DECLARADO POR SmartStaging, OS SERVIÇOS E TODOS OS PRODUTOS OFERECIDOS ATRAVÉS DOS SERVIÇOS SÃO FORNECIDOS “CONFORME ESTÃO” E “CONFORME DISPONÍVEIS” PARA UTILIZAÇÃO POR SUA PARTE, SEM QUALQUER REPRESENTAÇÃO, GARANTIA OU CONDIÇÃO DE QUALQUER TIPO, EXPRESSA OU IMPLÍCITA, INCLUINDO TODAS AS GARANTIAS OU CONDIÇÕES IMPLÍCITAS DE COMERCIALIZAÇÃO, QUALIDADE COMERCIALIZÁVEL, ADEQUAÇÃO A UMA FINALIDADE ESPECÍFICA, DURABILIDADE, TÍTULO E NÃO CONTRAFAÇÃO. NÃO GARANTIMOS, REPRESENTAMOS OU ASSEGURAMOS QUE A SUA UTILIZAÇÃO DOS SERVIÇOS SERÁ ININTERRUPTA, OPORTUNA, SEGURA OU ISENTA DE ERROS. ALGUMAS JURISDIÇÕES LIMITAM OU NÃO PERMITEM A EXCLUSÃO DE RESPONSABILIDADE DE GARANTIAS IMPLÍCITA OU DE OUTRO TIPO, PELO QUE A EXCLUSÃO DE RESPONSABILIDADE SUPRAMENCIONADA PODE NÃO SE APLICAR AO SEU CASO.

SECÇÃO 16 — LIMITAÇÃO DE RESPONSABILIDADE
NA MEDIDA MÁXIMA PERMITIDA PELA LEI, EM NENHUMA CIRCUNSTÂNCIA SmartStaging, OS NOSSOS PARCEIROS, ADMINISTRADORES, RESPONSÁVEIS, FUNCIONÁRIOS, AFILIADOS, AGENTES, CONTRATANTES, PRESTADORES DE SERVIÇOS OU LICENCIADORES, OU OS DA SHOPIFY E DOS RESPETIVOS AFILIADOS, SERÃO RESPONSÁVEIS POR QUALQUER LESÃO, PERDA, REIVINDICAÇÃO OU QUALQUER DANO DIRETO, INDIRETO, ACIDENTAL, PUNITIVO, ESPECIAL OU CONSEQUENCIAL DE QUALQUER TIPO, INCLUINDO, SEM LIMITAÇÕES, LUCROS CESSANTES, PERDA DE RECEITA, PERDA DE POUPANÇAS, PERDA DE DADOS, CUSTOS DE SUBSTITUIÇÃO OU QUAISQUER DANOS SEMELHANTES, QUER SEJAM BASEADOS EM CONTRATO, DELITO (INCLUINDO NEGLIGÊNCIA), RESPONSABILIDADE OBJETIVA OU, DE OUTRA FORMA, DECORRENTES DA SUA UTILIZAÇÃO DE QUALQUER UM DOS SERVIÇOS OU QUAISQUER PRODUTOS OBTIDOS PELA UTILIZAÇÃO DOS SERVIÇOS, OU PARA QUALQUER OUTRA REIVINDICAÇÃO DE QUALQUER FORMA RELACIONADA COM A SUA UTILIZAÇÃO DOS SERVIÇOS OU QUALQUER PRODUTO, INCLUINDO, ENTRE OUTROS, QUAISQUER ERROS OU OMISSÕES EM QUALQUER CONTEÚDO, OU QUALQUER PERDA OU DANO DE QUALQUER TIPO INCORRIDO EM RESULTADO DA UTILIZAÇÃO DOS SERVIÇOS OU DE QUALQUER CONTEÚDO (OU PRODUTO) PUBLICADO, TRANSMITIDO OU DE OUTRA FORMA DISPONIBILIZADO ATRAVÉS DOS SERVIÇOS, MESMO QUE TENHAM SIDO PARTILHADAS INFORMAÇÕES SOBRE ESSA POSSIBILIDADE.

SECÇÃO 17 — INDEMNIZAÇÃO
Concorda em indemnizar, defender e manter indemne SmartStaging, a Shopify e os nossos afiliados, parceiros, responsáveis, administradores, funcionários, agentes, contratantes, licenciadores e prestadores de serviços de quaisquer perdas, danos, responsabilidades ou reivindicações, incluindo honorários de advogados na medida do razoável, a pagar a terceiros em virtude ou decorrentes (1) da sua violação dos presentes Termos de Serviço ou dos documentos que os mesmos incorporam por referência, (2) da sua violação de qualquer lei ou dos direitos de terceiros, ou (3) do seu acesso e utilização dos Serviços.
Enviar-lhe-emos uma notificação sobre qualquer reivindicação passível de indemnização, desde que a falta de notificação expedita não constitua a sua isenção das suas obrigações, exceto no caso de prejuízos materiais. Podemos controlar a defesa e liquidação dessa reivindicação às suas expensas, incluindo a escolha de um advogado, mas não liquidaremos qualquer reivindicação que exija obrigações não monetárias da sua parte sem o seu consentimento (que não deve ser injustificadamente retido). Cooperará na defesa das reivindicações indemnizadas, incluindo ao disponibilizar documentação relevante.

SECÇÃO 18 — DIVISIBILIDADE
Caso qualquer disposição dos presentes Termos de Serviço seja considerada ilegal, nula ou inexequível, essa disposição deverá, ainda assim, ser exequível na medida máxima permitida pela lei aplicável, pelo que a parte inexequível será considerada separada dos presentes Termos de Serviço. Assim, essa determinação não afetará a validade e a exequibilidade de quaisquer outras disposições remanescentes.

SECÇÃO 19 — RENÚNCIA DE RESPONSABILIDADE; INTEGRALIDADE DO CONTRATO
A nossa incapacidade de exercer ou fazer cumprir qualquer direito ou disposição dos presentes Termos de Serviço não constituirá uma renúncia de tal direito ou disposição.
